The culture, friendships, and enjoyment at North Beach were destroyed
in one swift stroke, while Police Chief Art Howell allowed a ‘certain
element” to openly violate Mayor Cory mason’s orders – resulting in:

5 shot at North Beach and total mayhem and destruction!

One man, who was on Michigan Boulevard at the time of the shooting,
but declined to give his name, said he saw a group in the parking lot
near North Beach.

A dispute occurred in the parking lot and multiple people started
jumping on top of a truck. The truck then sped off and smashed into a
Jeep. At some point, someone started randomly spraying bullets at
people.

A woman who was near the beach at the time said the incident began
with an argument between two people that she estimated to be in their
early 20s. She said there was a crowd around them, encouraging the
confrontation.

“The kid just pulled out his gun and just starts airing it out,” the
witness said.

One person who was shot fell near her and she put pressure on his
wound, she said.

The witness also said she saw a girl who was walking from the beach
get shot in the arm.

RACINE — A vehicle with six children along with an adult woman driver
was near North Beach on Tuesday night when another vehicle drove past
and pepper sprayed everyone inside.

“A car just pulled on the side of us and Maced us,” said the driver,
who did not give her name.

The driver quickly pulled to the side of the road.

Witness Ambryia Mason, 18 of Racine, said she and others were walking
in the area when they saw a gold truck or SUV pull up, pepper spray
inside the other vehicle and then drive away.

“They jumped out, screaming for help,” Mason said.

Dickert is represented by Patrick Cafferty, whom had been exchanging information with the D.A’s office regarding Dickert’s altercation and physical assault upon 18 year old Christian Reynoso.

Journal Times editorial: State’s government bodies shouldn’t circumvent the open meetings law

Wisconsin’s open meetings law exists to ensure that government business, the people’s business, is conducted where the people can watch it happening. The exceptions to it, the instances where a governmental body can act in closed session, are generally limited to contract negotiations and personnel matters. That is as it should be.

As fierce advocates for the concept of “government in sunshine,” we were dismayed recently to read of the Madison School Board tiptoeing awfully close to the line between lawful and unlawful government meetings.

Under state law, school boards and other local public bodies must have a quorum — typically a majority or more — of members to take official action, and the action they take must occur in publicly noticed meetings.

“Walking quorums,” by contrast, are a “series of gatherings among separate groups of members of a governmental body, each less than quorum size, who agree, tacitly or explicitly, to act uniformly in sufficient number to reach a quorum,” according to the attorney general’s office.

They’re illegal because they can “render the publicly held meeting a mere formality,” according to the office.

Even if this practice does not violate the letter of the open meetings law, it certainly has the odor of not abiding by the spirit of the law.

Wisconsin Freedom of Information Council president Bill Lueders said the practice in Madison and in the Green Bay case “may not clearly violate the law, but it probably should be avoided, so as to not undercut the purpose of the open meetings law, which is to ensure that the deliberative process is public.”

Wisconsin Counties Association Not Subject to Open Records Law

Sept. 23, 2014 – A state appeals court has ruled that the Wisconsin Counties Association did not need to produce records requested by the Wisconsin Police Association because the Counties Association is not subject to public records law.

Under Wis. Stat. section 19.32(1), certain “authorities” must produce records for inspection if requested to do so. Authorities include state or local offices, elected officials, agencies, boards, commissions, and other government-related entities.

The Wisconsin Professional Police Association submitted two requests for records from the Counties Association – a nonprofit organization whose members are Wisconsin counties – which refused, arguing that it was not subject to public records law.

In Wisconsin Professional Police Assoc. v. Wisconsin Counties Assoc., 2014AP249 (Sept. 18, 2014), a three-judge panel for the District IV Court of Appeals agreed that the Counties Association does not qualify as an “authority” subject to public records law.

The panel rejected the Police Association’s claim that the Counties Association is a “quasi-governmental corporation” that falls within the statutory definition of “authority.”

The Counties Association is a “corporation,” the Police Association argued, because Black’s Law Dictionary defines a corporation as an entity created under state laws.

And under a prior case, the Police Association argued, the Counties Association was quasi-governmental because it resembled a governmental corporation.

“As the Counties Association notes, “’ to be a quasi-governmental corporation,’ an entity must first be a corporation,’” and the Counties Association is not a corporation,” wrote Judge JoAnne Kloppenburg, noting that nonprofits are unincorporated organizations.

The panel also rejected the Police Association’s claim that the Counties Association was considered a “governmental body” as used in the open meetings law. It said the Police Association forfeited that argument by not raising it at the circuit court.

“Moreover, even if we were to address the merits and resolve the issue, the Police Association does not persuade us,” Judge Kloppenburg wrote.

“In particular, the Police Association does not explain why a statute and informal opinions of the Attorney General which address open meetings ‘ought to be instructive’ when the topic here is public records.”

From this deeply flawed Ruling, Wisconsin Court of Appeals, with Judge Kloppenburg commenting, “As the Counties Association notes, “’ to be a quasi-governmental corporation,’ an entity must first be a corporation,’” and the Counties Association is not a corporation,” wrote Judge JoAnne Kloppenburg, noting that nonprofits are unincorporated organizations” the Pandora’s Box to Racine County’s Legal Secret Government was opened.

And as the Form 990 shows on page 9, the overwhelming majority of RCEDC’s Revenue is Taxpayer Provided Government Grants – to the tune of $5,307,800 in 2017.

And a loss for a little taxpayer funded “Loan Forgiveness” worth $110,429 – wonder who this was?

Who says Non-Profits are run by unpaid Volunteers? It can be VERY profitable to be involved with a Non-Profit. And note that in 2017, RCEDC granted $38,000 to Cory Mason’s unaccountable Rootworks – and for a further taxpayer *SURPRISE*,  Cory Mason just so happened to be a Board Member of RCEDC.  And BTW – RCEDC is now up to $706,818 in FORGIVEABLE LOAN EXPENSE. Who’s getting the Forgiveness, because the Taxpayer is getting the shaft!

While the American Policy Center decries Public/Private Partnerships

President Trump is calling for a major new investment for rebuilding the nation’s infrastructure of highways, bridges and more. There is no question that it needs to be done. However, it’s vitally important that local, state and federal government agencies avoid calls to fund this massive effort through so-called Public/Private Partnerships (PPPs). Local officials must understand that there is a vast difference between calls for a competitive biding process to select private companies for the projects verses an actual partnership with government.

In an act of what can only be viewed as naked desperation, the Journal Times publishes a single commentary in the Sunday newspaper by Anthony “the Mooch” Scaramucci defending the #Foxconn deal while pillorying Governor Evers.

Set aside that Scaramucci has never lived in Wisconsin, has most likely never met Tony Evers, lasted a total of six days in his job as Communications Director in the Trump administration and later called Trump an “intentional liar.”

The JT Editorial Board seemed to believe this media clown’s opinion was a worthy and valuable voice in the Foxconn discussion. Weren’t the guys from Duck Dynasty available for comment?

Talking Racine Panel Member Ken Lumpkin Chairs a BINGO Hall Which Hasn’t Paid Property Taxes Since 2011!

In attempting to find the answer to the question of why the Racine Equality Project shattered into disarray following the Complaint which was filed against Racine County Supervisor Monte Osterman, an investigation has discovered that at the same time (former) Racine County Supervisor  Ken Lumpkin, also a member of the Racine Equality Project, was the Chairman of the 501c-3 non-profit Northside Redevelopment Project INC., located at 1661 Douglas Avenue, also known as Flatiron Village Mall.

On June 25, 2014, The Racine Equality filed an Ethics Complaint against District 3 Racine County Supervisor Monte Osterman. Following the filing of the Complaint, Dr. Ken Yorgan had this to say:

The Racine Equality Project, in response to citizen concerns, has pursued an investigation into the activities of certain elected officials and non-elected public employees. This investigation has been done with a thorough examination of public records, including tapes and transcripts of public meetings and statements by the parties being investigated. What we have found is very revealing, often disappointing, and sometimes quite disturbing.

As a result of this investigation, and following review by independent legal counsel, a Compliant with substantial evidence has been filed with the Racine County Board of Ethics regarding certain activities by District 3 County Supervisor Monte Osterman. This is personally disappointing to me, because I was originally a supporter of Mr. Osterman when he ran for office, just over two years ago. Mr. Osterman ran and was elected following the retirement of Supervisor Diane Lange, who had served the County Board for many years with honor, integrity and courage and it is especially sad to reflect on the loss of her presence on the County Board.

The evidence that has been submitted to the Racine County Board of Ethics is factual and compelling. It is now their responsibility to review it, conduct a proper investigation, hear Mr. Osterman’s reply, and if necessary, refer the matter to the District Attorney’s Office for prosecution.

Complaint filed against county supervisor

RACINE COUNTY — A complaint has been filed against Racine County Supervisor Monte Osterman related to the Root River redevelopment project.

The complaint alleges that Osterman did not properly disclose financial interests and that the Root River Council, of which Osterman is a member, is not a nonprofit organization like it claims.

Assistant County Corporation Counsel Michael Lanzdorf confirmed Thursday that the county received the complaint. It now goes to county’s Board of Ethics, which will first determine whether there is probable cause to continue, and if so, would hold a hearing and issue their findings, Lanzdorf said.

Osterman said he had not seen the complaint and declined comment.

The complaint was filed Wednesday by Timothy Elmer, in cooperation with the Racine Equality Project. The Equality Project is a group of local residents that has filed several other ethics complaints against local officials. Elmer said Osterman has not been transparent about his economic interests related to the RootWorks: Root River Corridor Redevelopment Plan.

And of course, the Complaint was immediately dismissed and called frivolous – even though Monte Osterman never released any required IRS Form 990’s, as demanded by IRS Regulations, and shortly afterwards, Cory Mason’s wife, Rebecca Mason, stepped in as his Attorney and continued to provide cover for Monte Osterman and his failure to provide the required form 990’s, even though he had received tens of thousands of dollars in government grant money, much of it guided by John Dickert through the Wisconsin Coastal Management Program and DNR.

Complaint against county supervisor dismissed

RACINE — A complaint filed against Racine County Supervisor Monte Osterman regarding the Root River redevelopment project was dismissed Wednesday by the county’s Board of Ethics.

The complaint alleged that Osterman did not properly disclose financial interests in the project and that the Root River Council, of which Osterman is a member, is not a nonprofit organization as it claims.

The Internal Revenue Service confirmed the organization’s nonprofit status, Assistant County Corporation Counsel Michael Lanzdorf said.

Other allegations “are either unsupported by fact sufficient to suggest an ethics violation or unrelated to the discharge of Supervisor Osterman’s official duties as a board supervisor, and thus outside the board’s scope of authority,” Lanzdorf said before the Board of Ethics’ 5-0 vote to dismiss the complaint.

The complaint was filed by Timothy Elmer in cooperation with the Racine Equality Project. The Equality Project is a group of local residents that has filed several other ethics complaints against local officials.

In addition to questioning the Root River Council’s nonprofit status, Elmer claimed Osterman stood to benefit financially from the RootWorks: Root River Corridor Redevelopment Plan.

The Racine Equality Project turned out to be nothing but a paper tiger – led by a toothless Jim Spodick, who refused to take effective, coordinated legal action, which it had clear cause for! It was the final blow, which led to the dissolution of the emerging organization.

SO what had happened, and what went so wrong?

When the Complaint was being formulated, plans had been made for a major announcement at the Courthouse – with print and TV media present, Jim Spodick and Ken Yorgan in suits and ties, speaking to the press corps and more releases of information and statements to follow which were to be filmed by Scott Nelson. Assignments had been handed out, and everyone had their own area of responsibility. Then came the day of the Press Release concerning the Complaint being filed and the Press Conference which would follow.

And it fell flat on it’s face.

It didn’t happen.

Jim Spodick, Ken Yorgan, Scott Nelson and other members simply weren’t around…..

Two members dragged the podium down to the Courthouse – but the designated Spokespeople NEVER showed up – just a lone Journal Times Reporter.

The Office was found to be deserted –

Jim Spodick and Ken Yorgan had run away, and were nowhere to be found….

When Jim Spodick was presented with a request to obtain copies of other Racine County Officials Economic Interest Statements – he flat out refused.

What had gone wrong? What happened?

The search for answers began, and why I can’t say for sure what the answer is, because those in the know won’t reveal the answer – it is not in their best interest – I have my suspicions.

Searching around property records, I discovered that Flatiron Village Mall, 1661 Douglas Avenue, was being operated as a BINGO Hall, poorly maintained, and had not paid the property taxes due since 2011!

 

Racine County tax records indicate that Flatiron Village Mall, 1661 Douglas Ave., hasn’t paid a singe penny of their property taxes since 2011, and is now $217,604.36 in arrears! residents in the City of Racine should be outraged!

Flatiron Village Mall is controlled  by the Northside Redevelopment Project INC, a 501(c)(3) Non-Profit Corporation which has been granted a license to operate a BINGO Hall there, and is chaired by former Racine County Supervisor, and current Talking Racine Panel Member, Ken Lumpkin!

First, that they are operating a BINGO Hall at the location to fund their operation:

Second, the list of the 5 officers of the Corporation, indicating that Ken Lumpkin is the Chairman.

Third, A “Fuzzy” Revenue and Expense statement, which indicates that they are licensed to operate a Gaming establishment – and are there volunteers – Yes or No – is left unanswered….. It IS a cash business – so ponder that for a moment…. hmmmmm,! I can “guess the rest” LOL!

Fourth – the Northside Redevelopment Project donates all it’s proceeds – whose major contributor appears to be the BINGO Hall – to the Flatiron Business & Professional Association! HAR! HAR! HAR!

Nothing to see here – except more SCAM-O-RAMA RACINE! Sheriff Schmaling needs to investigate this outrage! While City of Racine/State of Wisconsin needs to revoke it’s gaming license and Racine County Executive Jonathan Delagrave needs to begin the tax foreclosure process so that the property can be sold to a developer who will pay their property taxes!

Meanwhile….Root River Council was terminated at (most likely) Monte Osterman’s request – failing to file form 990’s for certain years…. with the possible assistance of Rebecca Mason….

Then, like the Phoenix rising from the ashes – reborn under Brian O’Connell! It would appear that the grant money continues to flow in….

 

And in the end – Monte Osterman got the last laugh – and he who laughs last – laughs best!

Racine police involved shooting reports expected to go to DA next week

RACINE — One month to the day since Donte D. Shannon was shot by Racine police after allegedly brandishing a gun, the Wisconsin Department of Justice investigation into the incident is nearing completion.

In a statement Friday afternoon, Johnny Koremenos, the director of communications for the DOJ, wrote: “DOJ anticipates having all investigative reports and evidence to the DA next week for review.”

Racine County District Attorney Tricia Hanson will be the one to decide if charges against the two officers involved in the shooting are merited, according to the DOJ.

Hanson, speaking Jan. 29 to a crowd of demonstrators outside the Racine County Courthouse, 730 Wisconsin Ave., said that when the report is finished, she will need time to review it and then will sit down with the family.

“They get to be first in this process,” she said. “The entire investigation will be published after I have an opportunity to meet with the family … I will make every effort to achieve total transparency with the community. I understand you have questions, and those questions need to be answered. I just can’t answer them now.”

Nakia Shannon, Donte Shannon’s father, said he was disappointed to learn the status of the investigation from the newspaper and would have preferred to have heard directly from the Department of Justice.

Ex-officer Michael Slager pleads guilty in shooting death of Walter Scott

(CNN)In a plea deal with prosecutors, former South Carolina police officer Michael Slager admitted to using excessive force in the 2015 shooting death of Walter Scott.

Slager shot Scott in the back as the unarmed man was running away from Slager after a traffic stop. In a reversal from his previous account, Slager admitted in court Tuesday that he did not shoot Scott in self-defense and said that his use of force was unreasonable.

Scott’s death sparked renewed “Black Lives Matter” protests after the 50-year-old became the latest in a series of unarmed black men killed by police.

With his family and Scott’s family present, Slager pleaded guilty Tuesday in US District Court in Charleston to a federal charge of deprivation of rights under the color of law. In exchange for the plea, state murder charges, as well as two other federal charges, will be dismissed.

The civil rights offense has a maximum penalty of life in prison. The plea agreement states that the government will ask the court to apply sentencing guidelines for second degree murder, which carries up to 25 years in prison. He was taken into custody after the hearing and will remain there until sentencing later this year.

Scott’s mother said the sentence mattered little to her now that Slager had admitted responsibility.

“What made me feel good about it is that Michael Slager admitted what he did. That was enough years for me,” she said in response to the question how much time she wanted Slager to serve.

“No matter how many years Michael Slager gets, it would not bring back my son,” she said. “This is a victory for Walter. This is justice for the family, but this is just the beginning.”

Slager was an officer for the North Charleston Police Department when he pulled Scott over for a broken tail light. A few moments later, Scott ran away.

A foot chase ensued, and a bystander’s cell phone video captured Slager firing eight times — striking Scott five times in the back.
